WILL OF THE HONORABLE WILLIAM BARRELL 1749
THIS IS THE LAST WILL AND TESTAMENT
Of me William Barrell of the parish of saint martins in the fields in the county of Middlesex esquire. I leave the manner of my funeral to the discretion of my executors hereinafter mentioned and direct that herein shall not be expenses more than one hundred pounds. I give and devise all my freehold estate lands tenements and hereditaments in the parishes of Chicknell Saint James's and Writtle in the county of Essex or elsewhere all my leasehold estate in Ffenchurch Street London, and also all my goods, chattels and personal estate whatsoever not herein otherwise given or bequeathed to Colonel George Reede of Golden Square Westminster and Humphry Brent of the Middle Temple London Esquire, and their heirs in trust and to the several uses intents and purposes hereinafter mentioned and declared that is to say that they the said George Reede and Humphry Brent and the survivor of them and his heirs executors or administrators shall from and after my decease out of all or any part of my real estate and out of my personal estate not hereinafter specifically given as a legacy or directed by me, to be preserved and kept pay and discharge all my just bebts legacys and funeral expences and upon this further i trust that out of all or any part of my real or personal estate there shall be secured and paid unto my dear wife Mary Barrell the yearly sum of two hundred pounds during her life for her support and maintenance to be paid to her on the four most usual ffeasts in the year by quarterly payments that is to say Lady Day, Saint John the Baptist, Michaelmas, and Christmas and the first payment to be made upon Lady Day, Saint John the Baptist, Michaelmas day, and Christmas day which shall first happen after my decease and i will that the same be paid to her free and clear of and from all and all manor of reduction or abatement whatsoever this my will that my said wife shall continue to dwell in my house in York buildings in the parish of Saint Martins in the fields aforesaid for and during all the remainder of the term of years i have to come upon the lease thereof granted to me free from any rent bebts whatsoever taxes whatsoever which said rent dutys rates taxes and other charges shall from time to time be paid and discharged by my executors hereinafter mentioned and i do also give to my said wife the use of all my plate, pictures, furniture, and houshold goods whatsoever for her life as well what is in my house in York Buildings as what shall be at my house Croydon in the county of Surry with this provisor that my son hereinafter named shall be unmarried and whereas i am possessed of entituled to the sum three thousand four hundred pounds in the capital and principal stock of the governor and company Northants of Great Britain trading to the south seas in America al my will is upon this further trust that they the said George Reede and Humphry Brent and the survivor of them his executors or administrators shall and will permit and suffer my daughter Ann Barrell now living with me and about or near the age of thirty one years to recieve and take all such interest and dividends which from time to time shall be made or due upon the same for and during the term of her natural life and from and after the decease of the said Anne Barrell the aforesaid three thousand four hundred pounds south sea stock in case she marrys shall go to the nee and behoof as follows that is to say if but one son of the ssons of her body the aforesaid three thousand four hundred pounds south sea stock shall be to the use of such son if two sons two thousand pounds part of the said stock to the eldest son and the remainder being one thousand four hundred pounds youngest son if no son or sons and there be a daughter or daughters the said three thousand four hundred pounds south sea stock to  be disposed of to and among them and in such manner as my daughter Anne Barrell shall think proper by any deed or instrument with her hand and seal testifies by two or more credible witessess provided nevertheless that in case my said daughter shall happen to dye before such person she shall hereafter marry and without any issue of her body it is my will that the whole three thousand four hundred pounds capital south sea stock shall be taken as part of the residuum of of my personal estate and belong to my residuary legatee. I give and bequeath to my god daughter Anne Ffoster the sum of four hundred pounds to be paid to her within twelve months after my decease. I give and bequeath to my god son William Ffoster one hundred pounds to be paid to him within twelve months after my decease. I give to my cousen Elizabeth Phips the sum of twenty pounds. I give to Captain John Wingate and to Sarah his wife to each of them a ring to the value of one guinea. I give to my neice Anne Ffoster and to Richard Ffoster her husband to each of them a ring of the value of one guinea. I give to my honest comrade the honorable Andrews Windsor the sum of twenty pounds. I give to the before mentioned George Reede and Humphry Brent my trustees to each of them twenty pounds. I give to my servant Benjamin Jones all my wearing apparel both linen and woolen in case he continues to be my servant at the time of my decease and after my trustees shall have paid and discharged all my just debts and legacies hereinbefore mentioned my funeral expences and reimbursed themselves all such charges they or any of them may or shall have been put to in the execution hereof then i give and devise all my messuages, lands, tenements and hereditaments whatsoever in the said county of Essex and elsewhere and all the rest residue and remainder of my personal estate whatsoever not herein before specificaly given to my son Savage Barrell merchant at Lisbon in Portugal about or near the age of twenty eight years and now residing at Lisbon aforesaid and to his heirs executors administrators and assigns to the use and behoof of him the said Savage Barrell his heirs executors and administrators and it is my will that my said trustees or others of them shall not be answerable any otherwise than for his own proper act and not for the act reciepts or payments of each other or the act reciepts or payments of my said son Savage Barrell in the administration of all and singular my goods chattels debts credits and personal estate whatsoever neither shall my said trustees be answerable in any respect for any money lost by means of the insufficiency of securities or insolvency of any person and i do nominate and appoint the said George Reede, Humphrey Brent  and my said son Savage Barrell executors of this my last will and testament hereby revoking all wills by me formerly made in witness whereof i the said William Barrell to this my last will and testament contained in four sheets of paper of which i have caused to be written the parts of the  same times and date to the first three sheets have set my hand and to the last sheet my hand and seal the fifteenth day of May in the in the twelth year of the reign of our sovereign King George the second by the grace of God King of Great Britain yr' 1739 William Barrell signed sealed published and declared by the said William Barrell for and as his last will and testament in the presence of us who have in his presence and at his request subscribed our names as winessess John Willett rester in the Strand Rich Taylor in York Buildings. To the last will and testament of me William Barrell of the parish of Saint Martins in the Fields  in the county of Middlesex Esquire bearing date the fifteenth day of May 1739.

Whereas i have in my said will given and bequeathed to my God Daughter Anne Ffoster four hundred pounds and since the making my said will the said Anne Ffoster hath inter marryed with Joseph Higginson lieutenant quartermaster in the regiment under my command and hath recieved from me as a free gift and fortune with the said Anne Ffoster to the value of five hundred pounds and upwards now i do by this codicil revoke the said legacy of four hundred pounds so as aforesaid given to the said Anne Ffoster and i do by this codicil give and bequeath to my dear wife the sum of four hundred pounds as a further testimony of my love and affection to her and for her better support to be paid to her within three months after my decease and whereas by my said will i have directed my trustees therein mentioned to permit and suffer my daughter the Anne Barrell to recieve and take the interest and dividends due and to be made upon the sum of three thousand and six hundred pounds capital stock in the company trading to the south seas for and during the term of her life and after her decease that the produce thereof shall be to such uses as in my said will is particularly mentioned and whereas my said daughter Anne Barrell hath since intermarried with captain Charles Rainsford in the regiment at present under the command of col' Pusons. Now i do by this codicil ratifie and confirm the provision i have made for her in my said will and as a further testimony of my love and affection to Anne the wife of the said Charles Rainsford my said daughter i do give and bequeath to her the additional sum of six hundred pounds to be paid to her within three months after my decease and i do declare this to be a codicil to and part of my last will and testament in witness whereof i the said William Barrell have to this codicil set my hand the fifth day of April in the year of our lord one thousand seven hundred forty and three. Whereas thought fitten to increase my daughters portion I do hereby order and require my heirs executors and administrators to pay to the said daughter Anne Rainsford over and above what i have left her in my will one thousand pounds and accordingly i have delivered this signed with my own hand to my daughter to to remain in her custody and to empower her after my decease to recieve the above mentioned sum of one thousand pounds. 11th August 1749

Appeared personally James Burn of the parish of Saint Martin in the Fields in the county of Middlesex and Jane Moses of the same parish spinster and being severaly sworn upon the Holy Evangelists to depose the truth made oath as follows these deponents well know the honorable William Barrell late of the said  parish of Saint Martins in the Fields Esquire, deceased by having been his servants for upwards of five years next before his death which happened ninth day of this instant month of August, and they are well with his the said deceased's manner and character of writing his name having often while they so lived with him seen him write the same and having now carefully viewed the name William Barrell set and subscribed to the paper writing hereunto answered purporting a codicil to  the last will and testament of the said deceased and bearing date the fifth day of April in the year of our lord one thousand seven hundred forty and three, they do severally say that they do varily believe that the said name William Barrell to have been set and subscribed to the said codicil by and with the proper hand of the said William Barrell Esquire, deceased, James Burn, Jane Moses-----------Same day the said James Burn, and Jane Moses were sworn to the truth of this affidavit before me Rob' Chapman surrogate of Saint Stevens rectory Publick.

This Will Was Proved at London with two codicils "annexed?" the tenth day of August the year of our lord one thousand seven hundred and forty nine before the Worshipful Robert Chapman Pastor of Laws, Master Keeper or comissary of the prerogative Court of Canterbury lawfully constituted by the oath of Savage Barrell Esquire, the son of the deceased and one of the executors named in the said will to whom administration was granted of all and singular the goods chattels and credits of the said deceased being first sworn only to administer power reserved of making the like grant to George Reede and Humphry Brent Esquires those other executors when they or either of them shall apply for the same.
